LEGAL REGIME OF SERVICES AS OBJECTS OF CONTRACTUAL RELATIONS IN THE SPHERE OF ECONOMY

The article examines the issues of the legal
regime of services as objects of contractual relations
in the field of business. The key aspects of the
economic and legal nature of the service are
highlighted and it is noted that its universal
(unchangeable) feature within the framework of
economic turnover is commodity-based. The author's
understanding of the legal regime of services as a
certain order of regulating relations for the provision
of services is given, which is formed due to the
combination (combination) of different legal means in
nature, including those that legitimize the instruments
and means of state regulation of the relevant service
market and / or economic activity carried out within
it, as well as means of self-regulation (including professional market and individual-contractual selfregulation),
in order to realize the needs and
legitimate interests of customers, as well as support
economic law and order. In the context of the analysis
of individual types of services (transport, financial,
housing and communal, etc.), the main components of
the construction "legal regime of services" are
considered.
It is stated that a special legal regime in the field
of management is granted to “socially significant
services”, which are given special attention within the
framework of this article. It is determined that the
basis of the legal regime of a service, as an object of
economic rights, is the legal regime of economic
activity related to the provision of the corresponding
type of services. The existing regulatory approaches to
the content of the concept of “service” are analyzed.
The need for further development of legislative
provisions on the conclusion and execution of
contracts for the provision of services, including maintenance, is emphasized.
