PROBLEMATIC ASPECTS OF LEGAL LIABILITY FOR ENVIRONMENTAL OFFENCES UNDER MARTIAL LAW

Abstract

The article emphasises the importance and
relevance of the problematic issues of legal liability
for environmental damage under martial law.
Attention is drawn to the scale of environmental
damage which grows exponentially in proportion to
the deployment of hostilities. The author identifies the
main features of legal liability for such offences.
Possible options for compensation for the damage
caused are analysed.
The publication examines the peculiarities of
legal regulation of legal liability for environmental
offences under martial law. To this end, the author
analyses a number of international regulations that
laid the groundwork for the regulation of the relevant issue and compares them with the measures taken by Ukraine. Based on the results of the analysis, the author establishes that at the national and international levels, there is a need for clearer regulation and elimination of gaps in the legislation on legal liability for damage to the environment caused by violation of its chemical, physical and biological state during hostilities. It is emphasised that there is an urgent need to update the legislation on the procedure for compensation for such damage.
