LEGAL REGULATION OF LABOR RIGHTS OF WORKERS IN MODERN CONDITIONS: THROUGH THE LENS OF THE CONCEPTS OF DECENT WORK AND SUSTAINABLE DEVELOPMENT

Abstract

The issues and prospects for the development of
fundamental labor rights at a certain stage of societal
and state development are determined by the
interaction of philosophical-historical, globalization-
European integration, and information-technological
factors, as well as depend on global challenges and
threats. The study notes that the modern
understanding of this issue is grounded in the
paradigm of decent work, which is a key element of
sustainable development. Based on the analysis of
scholars’ opinions, national and international
legislation, the article characterizes the contemporary
concept of decent work. It is indicated that, in the
context of implementing this concept, a key element is
the ratification of international labor standards,
particularly the fundamental Conventions of the
International Labour Organization (ILO). The author
emphasizes the need to ratify ILO Convention № 190
on the elimination of violence and harassment in the
world of work (2019), which, together with ILO
Recommendation №206, serves as an important tool
for protecting workers’ rights from psychological,
physical, or sexual violence, forming part of the
decent work concept. The article also outlines other
challenges, including the insufficient implementation
of already ratified ILO Conventions into national
practice. An important aspect of the study is the
analysis of the direction of labor law development
represented by the concept of sustainable
development, initiated by the United Nations.
Achieving sustainable development is a global
interest, in which Ukraine has expressed its consent
and defined a range of international obligations, the
implementation of which is based on economic, social,
and environmental components, with labor as their
foundation. The article specifically highlights that the
greening of the labor market is one of the priority
directions for the development of the labor sector in
the context of sustainable development. The author
also concludes that the adoption of a new Labor Code
of Ukraine is necessary as a step toward creating a
unified and systematized normative-legal framework
that would regulate all aspects of labor relations, based on the concepts of decent work and sustainable development. Based on the conducted research, a series of other theoretical and practical recommendations have been formulated to improve Ukraine’s labor legislation.
