LEGAL REGIME OF VETERAN ENTREPRENEURSHIP

The article examines the legal regime of veteran entrepreneurship, which is formed at the intersection of administrative, social, entrepreneurial, financial, and tax law. Such an approach requires regulatory consolidation, unification of state support mechanisms, and the definition of a special legal status - that of a war veteran. A veteran entrepreneur is a general business entity endowed with an additional public-law status that determines the specific features of the legal regime governing the institution of veteran entrepreneurship.
It is demonstrated that the legal regime constitutes a set of regulatory and legal foundations that ensure the status, rights, obligations, and specific support conditions for subjects of veteran entrepreneurship. The legal regime of veteran entrepreneurship in Ukraine is analyzed, and its key characteristics are identified, including personalization, compensatory nature, the presence of special state support measures, the private-law and public-law character of legal relations, enhanced positive obligations of the state, and its cross-sectoral character.
It is asserted that the legal nature of veteran entrepreneurship entails enhanced positive obligations on the part of the state, which go beyond the general obligation not to interfere with the freedom of entrepreneurial activity and require active measures to ensure the possibility of conducting such activity. In this regard, state intervention in veteran entrepreneurship is recognized as targeted and legitimate, as it is grounded in the state's social functions.
Particular attention is paid to the need to strengthen the role of courts in protecting the rights of subjects of veteran entrepreneurship that are violated, unrecognized, or disputed, as well as to enhancing their procedural guarantees.
