MECHANISMS OF LAW PROTECTION FOR FAIR LABOUR CONDITIONS ACCORDING TO THE EUROPEAN SOCIAL CHARTER DURING THE MARTIAL LAW CONDITIONS IN UKRAINE

Abstract

The article examines the legal mechanisms for
protecting the right to fair working conditions in
Ukraine during martial law, through the lens of
obligations arising from the European Social Charter (revised), which serves as a key benchmark for
harmonized standards in the field of socio-economic
human rights protection. The author conducts an
analysis of national labor legislation provisions that
have been amended or temporarily suspended due to
the hostilities, and assesses their compliance with
international legal standards. The study synthesizes
doctrinal and practical approaches to maintaining a
balance between national security interests and
adherence to socio-labor guarantees. Particular
attention is devoted to the imperative of preserving the
core of social rights even under emergency legal
regime.
The article also analyzes project norms of the
new Labor Code of Ukraine and makes conclusions
regarding the necessity to improve some of them. In
particular, the author emphasizes the need to
introduce a legal definition of "fair working
conditions," which would contribute to the clarity of
interpretation of the codified act and ensure
consistency in law enforcement practice.
Furthermore, the article outlines directions for
enhancing legal protection mechanisms aimed at
ensuring the sustainability of Ukraine’s European integration course amid armed conflict.
