MODERN FORMS OF DOMESTIC VIOLENCE: CRIMINAL LAW CHARACTERISTICS

Abstract

The article analyzes the opinions of scholars and national legislation regarding the criminal law characteristics of modern forms of domestic violence in Ukraine, taking into account the latest manifestations and in the context of implementing international standards. The concept, types lambtypes, and peculiarities of domestic violence, as well as the challenges in qualifying certain forms of it, particularly psychological and economic violence, are examined. Emphasis is placed on the need to improve legislation in the field of combating domestic violence, particularly regarding the criminalization of phenomena such as stalking and cyber-violence, and on the importance of harmonizing national legislation with the provisions of the Istanbul Convention. As a result of the conducted research, the importance of a comprehensive approach to combating domestic violence is highlighted, which includes not only the implementation of legal mechanisms but also social, educational, and preventive measures for the effective protection of victims and prevention of violence in Ukrainian society.
