SAFEGUARDING HUMAN RIGHTS DURING THE ENTRY OF INFORMATION INTO THE UNIFIED REGISTER OF PRE-TRIAL INVESTIGATIONS

Abstract

The article examines the processes of creation
and functioning of the Unified Register of Pre-trial
Investigations (hereinafter - the URPTI). Based on the
analysis of the practice of its application, the author
outlines both positive aspects and factors which may
have a negative impact on the course of criminal
proceedings, in particular, on the initial stage of pretrial
investigation. The study examines the history of
the URPTI, analyses the state of research on this issue
by Ukrainian scholars, and summarises the case law
on these issues. The author identifies a number of
problematic aspects of the functioning of the URPTI,
in particular, conflicts between the Criminal
Procedure Code of Ukraine (hereinafter - the CPC of
Ukraine) and other laws of Ukraine. The author
reveals the problematic issues related to the
processing of anonymous reports, the legal nature of
minor acts, registration of crimes committed by a
specific individual or legal entity, as well as the use of
the URPTI during martial law and military
operations. The author proposes to introduce
artificial intelligence technologies to optimise the
functioning of the URPTI. The author emphasises the
need to harmonise the provisions of the CPC of
Ukraine with international legal standards, in
particular, the International Covenant on Civil and
Political Rights and the norms of European law, in
order to ensure the rule of law and procedural equality of the parties in criminal proceedings.
