Crime motive: criminological, criminal and legal aspects
Abstract
It is very important for legal science to reveal the criminological as well as criminal and legal aspects of the crime motive. Determination of the criminal behaviour motive effect on the criminal responsibility of the person allows one to develop guidelines for the appropriate and clear-cut qualification of the person’s misdeeds taking into account the motives of the latter.
The psychological aspects of the offender’s motivation should be considered for a proper understanding of motives since it is deep, internal psychological processes, that are not always understood without a detailed psychological study, which determine the person’s certain acts, the offender’s behaviour in particular. In order to better understand the nature of the motive, key notions should be singled out, namely needs, volition and purpose. These are the notions used by scholars when defining the motive.
