Problems of impositing disciplinary penalties of general disciplinary liability in labor law
Abstract
In the modern period of reforming labor legislation and enacting the new Labor Code, the improvement of the categorical apparatus of labor law deserves special attention. The institution of labor discipline is one of the most important in labor law, however, most of its norms have not undergone significant changes since the Soviet period, although new social and economical conditions and European integration processes require a radical change in approating the issues of encouragement, and in particular, impositing disciplinary sanctions. Conformity of the offence to the penalty, transparent mechanism of enforcement, justice and all employees equality constitute the effectiveness of norms of the labor discipline institution. The purpose of the article is to determine the peculiarities of imposing disciplinary accusations of general disciplinary liability in labor law.
