CHANGING OF ESSENTIAL CONDITIONS AND MOVING AS KIND OF MODIFICATION IN CONDITIONS OF AN EMPLOYMENT CONTRACT
Abstract
Changing of the employment contract
conditions under the general rule involves the
consent of the employee, but in some cases, with the
adherence to the special procedure it is allowed by
unilateral decision of the employer. The legal
regulation of changes in the terms of an employment
contract is actually carried out only by one article of
the Labor Code, which leads to an unclear
interpretation of the legal norm and mistakes in law
enforcement in practice. Improvement of the law
regulation of labor contract in the sphere of
changing of the employment contract essential
conditions and moving require a thorough scientific
study taking into account scientific approach which
based on the analysis of the current legislation and
draft law of the Labor Code. The purpose of the
article is to determine the peculiarities of legal
regulation of changing of the employment contract
essential conditions and moving in modern conditions.
