THE JURY TRIAL IN UKRAINIAN CRIMINAL PROCEDURE: CURRENT STATUS AND PROBLEMS OF FUNCTIONING

Abstract

legal acts on the issue of the functioning of the jury
trial in the national criminal justice system are
analyzed. The issues of the procedure for the
formation of jury list, the quantitative composition of
the jurors, the consideration of criminal cases in the
court with the participation of jurors, the decision of
the jury trial are considered. The issue of delimitation of the competence of professional judges and jurors in the Anglo-American and European models is being explored, a description of the model of the jury trial, which is valid in Ukraine, is introduced. The authors' suggestions on the quantitative composition of the court are given and the recommendations on the functioning of the jury institute as an effective instrument of direct participation of the people in the administration of justice are proposed.
