THE LEGAL PROBLEMS OF DIGITALIZATION IN THE FRAMEWORK OF NEW THREATS FOR SOCIAL WELFARE

The article deals with the problem of minimizing
the risks of digitalization in order to ensure its
social orientation. The phenomena of digitalization
(artificial intelligence, virtual enterprises, ecommerce,
etc.) are considered not only in terms of
their benefits, but also the possible negative consequences
of their uncontrolled or unfair use. The importance
of taking legal measures aimed at reducing
the risks of digitalisation is emphasized and appropriate
legislative amendments are proposed. In particular,
it is proposed to consolidate at the level of
the code act (on digitally relations): the concept of
digital rights, the principles of the use of digital
technologies and digital phenomena in public
spheres, the relevant tasks of the state, including the
elimination of digital illiteracy, the mandatory registration
of persons responsible for the use of such
resources, and the basic principles responsibilities in
this area.
Therefore, the use of digitized phenomena
(artificial intelligence, virtual enterprises, business
sites, etc.) testifies to their ambiguity: besides the
indisputable advantages (speed of correspondi processes, convenience, accessibility, costeffectiveness,
efficiency), they also have risks
associated with unfair and / or their uncontrolled
use, which could result in material loss and / or
endanger the safety of people and in the worst case
lead to the establishment of a dictatorship by persons
controlling artificial intelligence, him out of human
control. Under these conditions, the role of adequate
legal support for the civilized (taking into account
public interests) use of digitized phenomena and
corresponding consolidation in the codified act
increases a number of measures, including: defining
the concept of digital rights, consolidating the legal mechanisms for their protection, as well as the principles of the use of digital technologies and digital phenomena (such as the above) and the state's digitalization tasks, which should include two categories of means promoting their (digital) use of socially useful and minimizing the risks of uncontrolled and / or fraudulent use; overcoming digital illiteracy; introduction of state registration of persons responsible for use in business and other public spheres of digital technologies and digital phenomena; defining the basic principles of responsibility for unfair and / or uncontrolled or risky use of such resources in the economic and other spheres).
