DEVELOPMENT HISTORY AND CURRENT TRENDS OF THE PROBATION INSTITUTE IN UKRAINE

Abstract

In connection with bringing national legislation
up to international standards, before Ukraine faced
the task of creating such a tool, with which it is
possible would be to apply new approaches to the
enforcement of supervision of offenders, providing
psychological support and decision sociallyhousehold
problems. Such tool was introduced in
Ukraine, the Institute of probation. Today, probation is an essential element of criminal justice systems in
European countries, which in turn positively
contributes to the public safety and the fair
administration of justice.
The article is devoted to the history and modern
tendencies of functioning of the probation Institute.
The article analyzes the international legal experience
of the probation of such countries as USA, UK,
Sweden, Denmark, the Netherlands; the peculiarities
of the national model of probation and the proposal
on improving domestic legislation; the possibility of
implementation of the norms of international law on
the functioning of the probation Institute to the
legislation of Ukraine. The authors analyze various points of view of scientists regarding the definition of resocialization.
Consider some aspects of the use of probation in situations of armed conflict, in particular, stated that the persons who released from places of deprivation of liberty for temporarily national Ukrainian power of the territory are faced with the following problems: the lack of consolidation at the legislative level the question of the admission of term of punishment; lack of clear mechanism for the recovery of documents for the possibility of returning to controlled the territory of Ukraine; the lack of a clear position regarding the future fate of persons sentenced to life imprisonment, which remained on national areas and things that are unresolved and present.
