LEGAL PRINCIPLES OF ORGANIZATION OF ELECTRONIC PUBLIC REGISTERS IN UKRAINE

Abstract

The article is devoted to the analysis of legal
problems in the formation of such direction of
economic policy change as the formation of the system
of electronic public registers. This trend is considered
strategic, which involves taking into account public
and private interests while ensuring the information
and communication security of participants in
relations in the field of digital economy. Consolidation
of national and international legislation regarding the
implementation of warnings against threats to public
and private interests in the system of public registers
is a manifestation of the legal guarantee of its security.
The analysis of the current normative-legal acts on the
regulation of relations in the sphere of creation,
administration and use of separate electronic
registers in Ukraine, shows the lack of their
effectiveness for both business and society. The
essence of the legal foundations of reforming the
system of electronic public registers is substantiated.
In creating the legal basis for the implementation of
the functions of creating, maintaining, administering,
registering and interacting registries in modern
Ukraine, it is proposed to distinguish two stages. The
first stage – from 2004 to 2019, the second – from
2020. A scientific and practical commentary on the bill on public electronic registers is provided. The nature of the relations that arise in the specified sphere in their creation, management, interaction, administration, modernization, reorganization and liquidation are revealed. The legal problems of the use of the register information, including when involving it in circulation in other information and information and telecommunication systems, are exposed.
