THE CONCEPT AND ESSENCE OF THE EFFECTIVENESS OF LABOR LAW

Abstract

In the article the legal nature of the effectiveness
of labor legislation is analyzed. Aspects of the essence
of the effectiveness of labor legislation are described
in detail. The content and meaning of each is
characterized. The scientific approaches to the
scientific interpretation of the effectiveness of labor
legislation are presented. The author's unique
definition of the investigated legal phenomenon is
derived. The specifics of this legal category have been
identified.
Research into the effectiveness of legislation is
closely linked to the definition of its concept, nature,
characteristics, criteria, indicators, conditions, etc.
The questions of the effectiveness of the legislation, its
content, and the criteria that are an indicator of the
effectiveness of the legislation, refer to the problems
of legal science that have interested scientists since
the last century, and continue to be interested to this
day. As noted in the scientific literature, active
discussion of issues of the effectiveness of law and
legislation began in the second half of the XX century.
At the time, the authors considered the concept of
effectiveness because of the potential ability of the
legal outcome to influence public relations in a way
that promoted the desired goal and ensured the
achievement of a socially useful and objectively
justified goal. During this period, the foundations of
the theory of the effectiveness of legislation were
developed, which determined the directions of the
study of this phenomenon in the following years, and
accordingly, in the subsequent historical periods of
development of the theory of the effectiveness of the
legislation, the range of use of this concept was
expanded to certain branches of law and institutions of law. Despite the fact that the theory of the effectiveness of labor law was partly developed in Soviet times, the rapid change in the content of public relations in the field of organization, application and provision of work over time requires an up-to-date understanding of what constitutes effective labor law according to the current needs of society.
