DEVELOPMENT OF ECONOMIC LEGISLATION IN THE CONTEXT OF REFORMING ELECTRONIC PUBLIC REGISTERS

Abstract

The article deals with the problems of
reforming electronic public registers in Ukraine.
Theoretical development of the grounds for the
separation of two stages of reforming the system of
public registers is carried out. The bill on electronic
public registers is analyzed. The joint
recommendations of international organizations and
the Ukrainian authorities that implement projects on
combating and preventing corruption are
characterized. In particular, the International
Development Law Organization (IDLO), the Eastern
Europe Foundation, the State Agency for Electronic
Governance of Ukraine, the United States Agency for
International Development (USAID) and others. The
reasons for the low state of the state registers and the
prospects for its change for the better are revealed.
The bill on electronic public registers is analyzed.
The range of entities representing the public interest
in disputed relations regarding the monitoring,
protection and protection of information resources of
public registers is specified. The mechanism of
verification of information on beneficial owners in
Ukraine by NGOs has been critically evaluated. In
the process of verifying the credibility of information
about the final beneficial owners, conflicts / disputes
arise regarding the testing by public organizations of
the Unified State Register of Legal Entities,
Individual Entrepreneurs and Public Formations
(EDR) regarding the submission of incomplete, false
and distorted information about the beneficiaries.
The general principles of legal liability in the field of
registers and the grounds for bringing it were
commented on. The ways of development of economic
legislation in the context of counteraction to raiding, corruption and other abuses in the sphere of management, which is directly related to the interoperability of the register information of public electronic registers, are proposed.
