FEATURES OF TACTICS FOR DETECTING AND OVERCOMING FALSE TESTIMONY DURING THE INTERROGATION OF MINOR PERSONS IN THE VIDEOCONFERENCE MODE

Abstract

The article is devoted to the analysis of existing scientific works, current national legislation, international and European standards on tactics for detecting and overcoming false testimony of minors by videoconference during the pre-trial investigation.
Particular attention is paid to the interrogation of minors, in particular by videoconference. It is emphasized that the reliability of the testimony provided depends not only on the individual characteristics and family environment of the minor, but also on the conditions and manner of his interrogation. The importance of spreading the practice of creating specially equipped premises for conducting interviews (interrogations) of children - "rooms friendly to interviewing children" was emphasized. The importance of developing and adopting appropriate legal framework aimed at standardizing their equipment and use during the pre-trial investigation was emphasized. It is proposed to develop and approve a national methodology for assessing the reliability (validity) of the testimony of minors. Emphasis is placed on the expediency of involving psychologists to assess the reliability of the testimony of minors during the pre-trial investigation, in particular by videoconference.
Tactics and means for preventing, detecting and overcoming false testimony of minors during the pretrial investigation are generalized and systematized. Emphasis is placed on some features of their use in video conferencing. The legal and organizational directions of improving the tactics of detecting and overcoming false testimony of minors in the mode of videoconference during the pre-trial investigation are highlighted.
