GUARANTEES WHEN IMPLEMENTING SPECIAL ECONOMIC REGIMES: RECONSIDERING APPROACHES TO UNDERSTANDING

Abstract

The article is devoted to the issue of determining the content of state guarantees for business entities when introducing special business regimes. The author has detailed and analyzed the system of regulatory and legal support for guaranteeing the rights of business entities both in general and in connection with the introduction of special management regimes. In the conditions of a full-scale war on the territory of Ukraine, taking into account the predicted difficult post-war recovery period for the economy of our country, the mechanism of state guarantees is the "trigger" that can bring the economic system to the pre-war level. Based on the analysis of economic legislation, the works of Ukrainian researchers - specialists in the specified field, the actual situation of economic entities in today's conditions, as well as the correlation of the effectiveness of the introduction of special legal economic regimes, conclusions were drawn about the need to revise certain foundations of economic legislation. The author emphasized the importance of rethinking the system of state guarantees of the rights of economic entities, both in terms of the implementation of entrepreneurial activities in general, and in the sphere of the functioning of special economic regimes. It is proposed to develop a clear strategy for the introduction of certain types of special management regimes in the post-war period. It is also important to study the effectiveness of certain state guarantees and their impact on the functioning of special economic regimes, and especially on the growth of foreign investment volumes. Defects of normative and legal regulation in Ukrainian legislation are revealed: there is no definition of basic concepts and their consolidation at the legislative level. Amendments to the legislation in this area are proposed, in particular, regarding the improvement of the mechanism for the introduction of state guarantees.
