PROBLEMS OF THE DEVELOPMENT IN ELECTRONIC JUSTICE AT MODERN CONDITIONS

Abstract

The article is devoted to the analysis of some problems of the development of electronic justice in Ukraine at the current stage, taking into account the realities of the martial law. Questions were raised regarding the rethinking of the essence and role of electronic justice, the electronic court and further transformation and digitalization of the justice system, taking into account the realities of the war in the country and the needs of progress regarding the digital development of justice.
Problematic issues of the functioning of the Unified Judicial Information and Communication System, its already operational modules Electronic Cabinet, Electronic Court and video conferencing service are revealed.
It was established that the state should change its approach to installing license programs at workplaces and server equipment of the judiciary. This issue is directly related to the security and preservation of personal data and identification information of participants in civil court proceedings.
Considered and substantiated possibility of introducing changes in the legislation regarding the introduction of a remote court session without the presence of judges and secretaries of the court session in the courthouse in modern martial law conditions.
An analysis of the risks and advantages of using artificial intelligence for the development of electronic justice was carried out. It is indicated that compliance with the fundamental tasks of a fair trial and the principles of procedural law can become a problem for artificial intelligence when it deviates from the usual legal conditions. Selected proposals for the safe implementation of technologies and programs in court processes.
