DEVELOPMENT OF ADMINISTRATIVE PROCEDURE: HISTORICAL ANALYSIS AND PROSPECTIVE LEGISLATION

Abstract

This article, based on an analysis of scholarly perspectives and national legal norms, explores the definition of the term "administrative procedure" and examines the issues surrounding the development of the administrative procedure as the process for resolving and considering administrative cases. It affirms that administrative procedure has become an inseparable part of democratic society, contemporary governance, and the maintenance of the rule of law while safeguarding the rights and freedoms of citizens. The authors have ascertained that Ukraine's indigenous administrative procedure commenced its development in 1991 in parallel with the establishment of its autonomous administrative law system, underpinned by democratic principles and human rights standards. Subsequent to this milestone, a series of laws and regulatory acts were enacted to regulate administrative procedures and protect citizens' rights in administrative matters. It is emphasized that in order to establish transparent and predictable operations within public administration and ensure the protection of the rights and legitimate interests of private individuals in the domain of public law, the introduction of a comprehensive law on administrative procedures is imperative. The authors provide an overview of the new specialized law of Ukraine titled "On Administrative Procedure," which, among other aspects, introduces a novel approach to administrative procedural law.
