RIGHT TO AN EFFECTIVE REMEDY AND TO A FAIR TRIAL IN THE PRACTICE OF THE ECHR

Abstract

The article clarifies the essence and defines the
main structural elements of the right to a fair trial. The
modern understanding of the right to a fair trial in the
practice of the European Court of Human Rights is
analyzed. The conceptual principles of improving the
process of implementation into the national legal
system of the practice of the European Court of
Human Rights regarding the application of Article 6
of the Convention on the Protection of Human Rights
and Fundamental Freedoms of 1950 have been identified. The main shortcomings and problems of practical implementation of the right to a fair trial in the national judiciary have been revealed. Ways to solve identified problems and mechanisms for improving the national legal system are defined.
