DIFFERENTIATION OF PERSONNEL SECURITY OF WORK OF NOTARIES IN UKRAINE

Abstract

The article provides a detailed review of legal
relations that relate to the issue of staffing notaries. It
was concluded that the staffing of notaries involves a
special procedure for the selection of personnel, their
placement and is characterized by increased
qualification requirements for the work of a notary,
both from the point of view of professionalism and
humanity and morality. The article provides its own
understanding of the concept of "staffing of notaries
in Ukraine", emphasizes its importance and timeliness
of formation. Within the framework of the study, the
main legal acts in the specified area were
characterized.
Special attention was paid to the procedure for
the actual personnel selection of persons to work as
notaries, and on the basis of this, the main features
were highlighted, among which were named: 1) a
clear definition of the circle of subjects who,
according to their administrative and legal status, can
exercise their right to receive an employment
certificate notary activity; 2) professional selection is
carried out in strict accordance with the normative
legal acts adopted in the field of notarial activity,
which detail aspects not only of admission to the
profession of notary, but also clearly regulate the
implementation of personnel selection for the notary
system; 3) establishment of special conditions for
obtaining the right to pass a qualifying exam and
obtaining a certificate of the right to engage in
notarial activity; 4) the basis for appointment to the
post of state notary or for registration of private
notarial activity is obtaining a certificate of the right
to engage in notarial activity; 5) staffing of notaries is
carried out in accordance with a specific notary
district; 6) differentiating the work of public and
private notaries and ensuring their activities,
including through personnel selection for work in notary offices; 7) a special procedure for confirmation of qualification by a person who did not perform private notarial activity is established; 8) when forming personnel support for notaries, special attention should also be paid not only to professional requirements for notaries, but also to moral ones; 9) establishment of special personal requirements for staffing of notaries and the so-called notary dress code in relations with individuals and legal entities applying for the performance of notarial acts.
