REFORMING ECONOMIC LEGISLATION UNDER MARTIAL LAW

Abstract

The article is devoted to the issues of reforming
legislation in the field of legal regulation of economic
relations under the conditions of the legal regime of
martial law. The author analyzed the main
prerequisites for updating economic legislation, as
well as various types of challenges and threats to
national security in general and to the economic
security of the state in particular. The article examines
the issue of the mutual existence of the Civil and
Economic Codes of Ukraine and possible negative
consequences of their simultaneous application. It has
been proven that the aggravation of the long-standing
debate between representatives of civil and economic
law occurred in connection with the ideas of
reforming national legislation in the field of economy.
In the conditions of a full-scale war on the territory of
Ukraine, taking into account the predicted difficult post-war period of recovery for the economy of our
country, the introduction of a special management
regime can become one of the powerful "catalysts" for
the development of the de-occupied territories and the
economy as a whole. The article emphasizes that the
majority of economic and legal reforms carried out
were of a fragmented nature and did not have a longterm
positive impact on economic relations.
The author emphasized the importance of
conceptual refinement of the conceptual foundations
of economic legislation reform in order to change
approaches to the regulation of a whole range of legal
relations. The main problems that need to be solved
when reforming economic legislation are outlined.
Particular attention is paid to prospects, threats and challenges to the economic security of the state and ways to avoid them. It is proposed to create one's own unique methodology for determining directions for updating economic legislation in order to promote the fastest possible recovery of the economic system in the post-war period, etc.
