USE OF EUROPEAN EXPERIENCE IN THE ISSUE OF PAYMENT OF PROSECUTORS IN UKRAINE

Abstract

The article examines the system of remuneration of prosecutors in European countries and proposes to reform the legislation of Ukraine taking into account this experience. An analysis of models of organization of functioning of salaries of prosecutors in Spain, Latvia, France, Germany, Great Britain, Ireland is carried out, according to which the remuneration of prosecutors is directly related to the system of remuneration of judges or the general model of remuneration of civil servants, which contributes to ensuring institutional balance in the justice system. Common features of such models are identified, which are a clear definition of the place of the prosecutor's office in the distribution of state authorities, regulatory certainty of the salary structure, its transparency, hierarchy of positions, predictability and stability of material support. It is emphasized that the status of the prosecutor's office in Ukraine currently remains uncertain, which entails the creation of certain institutional problems, in particular, in the issue of material support of prosecutors. Problematic aspects of the model of remuneration of prosecutors in Ukraine have been identified, which are characterized by a different approach to the formation of remuneration for certain categories of prosecutors and law enforcement officers, insufficient conceptual certainty of the principles of justice, the absence of a single long-term strategy for the financial independence of the prosecutorial corps and the predictability of material support. According to the results of the study, directions for reforming the legislation of Ukraine have been proposed, aimed at the need to clearly define the status of the prosecutor's office in the structure of state authorities, as one that belongs to the judicial branch of government and bringing the level of remuneration of the prosecutor to the level of judicial remuneration.
