THE ESSENCE OF UNITY AND DIFFERENTIATION OF THE LEGAL REGULATION OF LABOR RELATIONS OF EMPLOYEES IN THE CONSTRUCTION INDUSTRY

Abstract

The study of the unity and differentiation of the
legal regulation of labor relations should be
considered one of the most fundamental theoretical
and practical problems of labor law. The study of the
unity and differentiation of the legal regulation of
labor relations of workers in the construction industry
is no exception, because it will allow to highlight the
specified classical principle of legal regulation of
labor relations in its specific applied dimension, to
reveal specific features of its manifestation in the
specified field, thus improving the understanding of it
essence and purpose.
The purpose of the article is to clarify the
essence of unity and differentiation of the legal
regulation of labor relations of workers in the
construction industry.
The article reveals the peculiarities of scientific
and theoretical approaches to determining the essence
of unity and differentiation of legal regulation of labor
relations as a general principle of labor law. It was
concluded that the principle of unity and
differentiation of the legal regulation of labor
relations plays an important role in ensuring the
equality of rights and freedoms of citizens like no
other. In the future, it is proposed to consider the
essence of unity and differentiation of legal regulation
of labor relations of workers in the construction
industry as: legal principle (key principle, starting
idea) of labor law, as well as legal regulation; as a
direction (tendency) in the construction of legal
material, which provides legal regulation of labor
relations of workers in the construction industry; as a
set of means and methods of organizing regulatory
material that regulates the labor relations of workers
in the construction industry; a tool for increasing the
guarantees of the implementation of the labor rights
of workers in the construction industry. It is noted that the most generally accepted and universal is the first of the proposed approaches, according to which the unity and differentiation of the legal regulation of labor relations of workers in the construction industry should be defined as the starting idea and guiding principle, an undeniable requirement for the legal regulation of labor relations of workers in the construction industry.
